Terms of service

DRAFT — this text has not been through legal review and is not binding.

1. Acceptance

By using the platform you accept these terms. Where a separate agreement has been signed on behalf of an organisation, that agreement prevails in case of conflict.

2. The service

BizSim is a multi-tenant software service covering training, exams, simulations, hackathons, certificates and analytics. Which modules are active depends on the subscription plan.

3. Accounts and security

Users are responsible for the security of their account. Two-factor authentication is mandatory for admin roles. Sharing credentials is prohibited.

4. Seat licensing

A subscription is capped by its seat count. When the cap is reached no further participant can register. The seat count can be raised at any time.

5. Acceptable use

The platform may not be used for unlawful purposes, to infringe the rights of others, to attempt unauthorised access, or for automated bulk requests.

6. Content and ownership

Content an organisation uploads (programmes, scenarios, projects) belongs to that organisation. The platform itself, its code and its design belong to BizSim.

7. Availability

We aim for uninterrupted service, but planned maintenance and provider-side outages can occur. Planned work is announced in advance.

8. Fees

Fees are billed monthly on the seat count. Service may be suspended if payment is late. Price changes are announced at least one billing period in advance.

9. Termination

A subscription can be cancelled at the end of the current period. Serious breach of these terms may lead to immediate suspension. A reasonable window for data export is given after cancellation.

10. Limitation of liability

To the extent permitted by law, we are not liable for indirect damages. Total liability is limited to the subscription fees paid in the preceding twelve months.

11. Governing law

These terms are governed by the law of the country in which the provider is registered. Disputes are heard by the competent courts of that jurisdiction.

12. Contact
